The problem we face in America today is constitutional. Though unintended, the Constitution--and the jurisprudence that has since developed--has made the Judiciary the overlords of our country. This must be changed by extreme action of the President and Congress, while the Republicans still hold power in both branches. Thomas Jefferson offers the basis in our founding for this action : The Constitution... meant that its coordinate branches should be checks on each other. But the opinion which gives to the judges the right to decide what laws are constitutional and what not, not only for themselves in their own sphere of action but for the Legislature and Executive also in their spheres, would make the Judiciary a despotic branch.
